Data Sharing Terms and Conditions
IMPORTANT INFORMATION ABOUT YOUR DATA SHARING TERMS AND CONDITIONS
These Data Sharing Terms and Conditions ("Terms") explain how First National Bank of Omaha ("Bank") provides certain account information to a third-party company at your direction.
Please read these Terms carefully. By selecting "Continue" or a similar button (or otherwise authorizing data sharing), you acknowledge that you have read and agree to these Terms.
Definitions
- "Bank," "we," "us," and "our" mean First National Bank of Omaha and, where applicable, our affiliates and service providers acting on our behalf.
- "You" and "your" mean the consumer or business customer authorizing data sharing, and any person you authorize to act for you (such as an authorized signer, administrator, or other representative).
- "Account" means an eligible consumer or business financial account maintained by you with the Bank that you authorize for data sharing, as made available through the Service and subject to applicable law.
- "Company" means the third-party company you choose to receive your Data (for example, an app, website, or service provider that is not affiliated with the Bank).
- "Data" means the account information you authorize us to share, which may include (as available): account ownership, contact information, account type, balances, transaction history, and other information generally available through our digital banking channels for the accounts you select. Some Accounts and Data may not be eligible for the Service.
General Terms
These Terms apply when you instruct the Bank to share Data with Company through a data sharing connection (the "Service"). We provide the Service as a convenience. We may change, suspend, or discontinue the Service (in whole or in part) at any time.
Your Authorization to Share Data
When you use the Service, you authorize the Bank to provide your Data to Company for the purpose of supporting the services you receive from Company.
You understand and acknowledge:
- You are responsible for selecting Company and deciding what accounts and Data to share.
- Not all accounts or all Data may be available for sharing through the Service.
- We may require you (or your authorized representative) to complete identity verification and authentication steps before we share Data.
How Data Is Transmitted
We will use reasonable efforts to provide Data to Company. Data is transmitted electronically across networks, and delays, interruptions, or failures may occur (for example, due to maintenance, outages, or network issues). The Bank is not responsible for any inability of Company to receive or use Data.
Company's Use of Data
Once Data is received by Company, Company may use, disclose, and otherwise process the Data in accordance with:
- the agreements you have with Company, and
- Company's privacy policy and security practices.
The Bank does not control Company's use of Data and is not responsible for Company's products or services, or for Company's privacy or security practices.
Privacy and Security
The Bank will share Data only as you authorize through the Service. We do not guarantee the security of Data after it is received by Company. You are responsible for reviewing Company's privacy policy and terms before authorizing data sharing.
Fees
The Bank does not charge you a fee to use the Service, but Company may charge you fees. If Company charges fees, those fees are between you and Company.
Other Terms
These Terms of Use do not supersede the agreements, terms and disclosures or other supporting documents applicable to other products or services that you may have previously acquired from us or that you may acquire from us in the future including, without limitation, the terms applicable to your Accounts. You should review those specific terms and conditions.
Changes to These Terms
We may modify these Terms by posting an updated version. The updated Terms will apply after they are made available to you through our website, app, or the Service. Your continued use of the Service after the effective date of an update means you accept the updated Terms.
Stopping Data Sharing (Revoking Access)
Your authorization remains in effect and allows ongoing sharing of your Data as updates become available until you revoke access, or the connection is terminated. You may stop sharing at any time using the Service controls (if available) or by contacting FNBO.
Security Monitoring and Suspension
To protect the security and integrity of its systems and customer information, the Bank may monitor use of the Service and may suspend or limit data sharing if suspected unauthorized access, fraud, misuse, or other security concerns are detected.
Important: Stopping data sharing prevents future sharing through the Service, but it does not require Company to delete Data it previously received. You must contact Company directly to request deletion or other actions regarding Data already in Company's possession.
Limitation of Liability
To the maximum extent permitted by law, the Bank will not be liable for losses or damages arising from:
- your use of Company's products or services,
- Company's use, disclosure, or handling of Data, or
- any interruption, delay, or failure in providing Data through the Service.
Governing Law; Venue
Unless we otherwise agree in writing, Nebraska law governs these Terms of Use and all aspects of our relationship with you. If any part of these Terms of Use is invalid or unenforceable, the remainder will stay in effect.
